Property Division
In Nova Scotia property division is done during the divorce process using the Matrimonial Property Act. In essence, this statute says that property acquired prior to and during the marriage is divisible 50/50. There are certain exemptions to property (as can be seen HERE) that is presumptively divisible in this way. Inherited property and business assets, for example, are presumptively excluded from an equal division. Other assets can be divided unequally based on a number of factors, enumerated in Section 13 of the Matrimonial Property Act, as you can see HERE.
